Welcome to Blank Beauty.

These Terms of Service (“Terms”) apply when you visit our website, use our customization tools, create or share a custom product, or purchase products from Blank Beauty, Inc. (“Blank Beauty,” “Blank,” “we,” “us,” or “our”).

By using our website or Services, you agree to these Terms and the policies referenced here. If you don’t agree, please don’t use the Services.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform we use to sell and market our products and Services.

1. USING BLANK BEAUTY

You must be old enough to legally use and purchase products through our Services in your location.

Please use Blank Beauty responsibly and lawfully. You may not use our Services to break the law, interfere with our systems, introduce malicious code, violate someone else’s rights, or otherwise misuse the Services.

We may refuse service, cancel an order, or restrict access when reasonably necessary to protect Blank, our customers, or others.

2. CUSTOM PRODUCTS

One of the things that makes Blank Beauty special is the ability to create products that are uniquely yours.

You may be able to choose colors, names, text, images, designs, or other customization options for your product. We refer to the things you provide or create through these tools as “User Content.”

Make it yours. Just make sure it’s yours to use.

You are responsible for the names, text, images, designs, and other content you submit for your custom product.

Please don’t submit content that infringes someone else’s intellectual property or other legal rights, falsely suggests an affiliation or endorsement, or is otherwise unlawful.

By submitting User Content, you confirm that you have the rights or permissions reasonably necessary for Blank to use it as described in these Terms.

3. HOW WE HANDLE CUSTOM CONTENT

When you submit a name, image, design, or other User Content, you’re asking Blank to use that content to create and provide your customized product and related Services.

You keep whatever ownership rights you have in your User Content.

Customer-created products and content may also appear through features that help people discover, share, or purchase Blank products. For example, a custom shade or its name may appear on our website, in product listings or recommendations, in advertising, or through third-party sales and marketing platforms.

Some of this happens automatically as part of the systems we use to operate and market Blank.

Because these systems can be automated, the fact that a customer-created product or its User Content is manufactured, displayed, advertised, recommended, shared, or otherwise processed does not necessarily mean that Blank manually reviewed, selected, or legally approved that content.

Unless Blank expressly says otherwise, displaying or marketing customer-created User Content does not mean Blank claims ownership of it or represents that Blank is affiliated with, sponsored by, or endorsed by any person or brand referenced in that content.

We may use automated tools, filters, or human review to help identify content that may violate these Terms.

4. CONTENT WE MAY NOT ACCEPT

We want customers to have plenty of freedom to create something personal and fun. At the same time, there are some things we may not be able to create, display, or promote.

Please don’t submit content that:

• infringes or violates someone else’s intellectual property or other rights;
• falsely suggests that a person, company, or brand sponsors, approves, or endorses your product;
• is unlawful, fraudulent, threatening, defamatory, or malicious;
• contains malicious software or code; or
• otherwise violates these Terms.

We may reject, remove, rename, hide, stop promoting, or block content when we reasonably believe it violates these Terms, applicable law, or another person’s rights.

We may also take reasonable steps to prevent content that has previously caused a legal or rights-related issue from being submitted or promoted again.

The fact that our systems do not flag or reject something does not mean Blank has determined that it is legally permissible to use.

5. INTELLECTUAL PROPERTY

We respect intellectual property rights and expect our customers to do the same.

If we receive a credible complaint that customer-submitted content may violate someone else’s rights, we may remove, disable, rename, reject, hide, or block that content while we review the issue.

We may also remove the affected content from advertising, product feeds, catalogs, social media, recommendations, and other marketing channels.

Taking those steps does not necessarily mean that Blank or the customer agrees that infringement occurred. Sometimes removing disputed content is simply the most practical way to resolve a concern.

6. OUR PRODUCTS AND COLORS

We work hard to accurately display our products and colors.

However, screens, lighting, materials, manufacturing tolerances, pigments, and other factors can affect how a color appears. We cannot guarantee that a physical product will look exactly the same as it appears on your screen.

All of our products are backed by our 100% Color Match guarantee, so please reach out to our team if you have any feedback on your shades.

Product availability, quantities, and pricing may change from time to time.

7. ORDERS AND BILLING

Please provide accurate and current information when placing an order.

We may limit, reject, or cancel an order when reasonably necessary, including when we suspect fraud, an obvious pricing or product error, misuse of our Services, or a violation of these Terms.

If we change or cancel an order, we may try to contact you using the information provided with your order.

8. RETURNS AND REFUNDS

Returns, exchanges, cancellations, and refunds are governed by our Return Policy.

Nothing in these Terms limits any consumer rights that cannot legally be limited.

9. THIRD-PARTY SERVICES

We work with third parties that help us provide, sell, advertise, and improve our Services, such as e-commerce platforms, payment providers, shipping companies, advertising platforms, analytics providers, and technology providers.

We may share or transmit information and content to these providers as reasonably necessary to provide and market the Services.

We may also link to third-party websites or services.

We aren’t responsible for third-party websites, products, services, policies, or content that we don’t control. Your use of those services may be subject to their own terms and policies.

10. BLANK BEAUTY’S INTELLECTUAL PROPERTY

While your User Content belongs to you or its respective owner, Blank’s content belongs to Blank or our licensors.

Our website, technology, software, logos, trademarks, graphics, photography, designs, product technology, and other Blank-created materials are protected by intellectual property laws.

Using Blank Beauty does not give you permission to copy, reproduce, sell, distribute, or commercially use our intellectual property except as expressly permitted by us or by law.

11. THINGS YOU CAN’T DO

Please don’t misuse our Services.

Among other things, you may not:

• use the Services for unlawful purposes;
• violate another person’s intellectual property, privacy, publicity, or other rights;
• impersonate another person or misrepresent your affiliation with someone;
• attempt to interfere with or compromise our systems or security;
• introduce viruses, malware, or other harmful code;
• scrape or automatically collect information from our Services in violation of applicable law or our restrictions;
• attempt to bypass reasonable technical or content restrictions; or
• use our Services in a way that could materially harm Blank, our customers, or others.

We may restrict or terminate access to the Services when reasonably necessary to address misuse.

12. IF SOMETHING GOES WRONG WITH USER CONTENT

You are responsible for the content you submit and for your use of our Services.

If your content or conduct results in a third-party claim against Blank because you violated these Terms or someone else’s rights, you agree, to the extent permitted by law, to indemnify and hold Blank Beauty and our affiliates, officers, directors, employees, agents, and service providers harmless from resulting claims, losses, damages, and reasonable costs, including reasonable legal fees.

We reserve the right to participate in or control the defense of a claim covered by this section, and you agree to reasonably cooperate with us.

Nothing in this section applies where responsibility cannot legally be shifted to you.

13. WARRANTIES

We work hard to provide a great experience, but no website or technology service is perfect.

Except for warranties that we expressly provide or that apply by law, the Services are provided on an “as is” and “as available” basis.

We don’t guarantee that the website or Services will always be uninterrupted, error-free, or available.

Blank does not provide legal advice or intellectual-property clearance for customer-submitted content. The fact that our systems allow content to be created, manufactured, displayed, advertised, or distributed does not mean we’ve determined that the content is legally permissible to use.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Blank Beauty and our affiliates, officers, directors, employees, agents, and service providers will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services.

Where applicable law does not allow a particular limitation, that limitation will apply only to the maximum extent permitted.

Nothing in these Terms limits liability that cannot legally be limited.

15. SUSPENDING OR ENDING ACCESS

Most customers will never have to think about this section.

We may suspend or terminate access to our Services when reasonably necessary because of fraud, unlawful activity, repeated violations of these Terms, infringement of another person’s rights, security concerns, or other serious misuse.

Sections of these Terms that are intended to continue after termination—including provisions relating to intellectual property, User Content, licenses, indemnification, and limitations of liability—will continue to apply.

16. CHANGES TO OUR SERVICES OR THESE TERMS

Blank Beauty will continue to grow and change, and these Terms may change with it.

We may update our Services, products, features, pricing, policies, or these Terms from time to time.

When we update these Terms, we’ll post the current version on our website and update the date at the top.

Your continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.

17. PROMOTIONS AND GIVEAWAYS

From time to time, we may offer giveaways, sweepstakes, promotional gifts, or other promotions.

Promotions may have additional rules covering things like eligibility, entry periods, prizes, and winner selection. If additional rules apply, we’ll make them available with the promotion.

Unless otherwise stated, no purchase is necessary to enter or win a sweepstakes.

Promotional gifts are available while supplies last unless otherwise stated.

18. SEVERABILITY

If one part of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue to apply.

The affected provision will be enforced to the maximum extent permitted by law.

19. NO WAIVER

If we don’t enforce a provision of these Terms on one occasion, that doesn’t mean we’ve waived our right to enforce it later.

20. ENTIRE AGREEMENT

These Terms, together with the policies referenced in them, form the agreement between you and Blank Beauty regarding your use of the Services unless we have entered into a separate written agreement with you.

21. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, except where applicable consumer law requires otherwise.
